MEMBERSHIP AGREEMENT & LIABILITY WAIVER

By enrolling and electronically signing below, I (“Member”), or if the Member is a minor, the Parent/Legal Guardian, acknowledge that I have read, understood, and agree to all terms and conditions of this Membership Agreement & Liability Waiver.

ASSUMPTION OF RISK

I understand and acknowledge that participation in martial arts and/or combat sports involves inherent and significant risks, including but not limited to violent and sudden movements, intentional and/or unintentional strikes, joint locks, chokes, strangulation, throws, takedowns, falling, chest compression, twisting or manipulation of the limbs, head, neck, wrists, contact with the groin area, spinal injuries, paralysis, and death. These risks cannot be eliminated, even with proper instruction, supervision, or the use of protective equipment.

I understand and agree that the use of the Gym’s facilities and my and/or my minor child’s presence at the Gym and participation in any Gym program, class, or activity is entirely at my own risk. I further understand that physical contact between instructors and Members, and between and among Members, is a necessary and integral part of training.

I acknowledge and accept these risks.

MEDICAL ACKNOWLEDGMENT

I represent and warrant that I and/or my minor child are physically and mentally fit to participate in the Gym’s programs and activities. I understand that participation involves cardiovascular and physical exertion and should not be undertaken by individuals with known or unknown medical conditions that could be aggravated by such activity.

I acknowledge that the Gym, its owners, employees, and instructors are not medical professionals and provide no medical advice. In the event of a medical emergency, I authorize the Gym to obtain emergency medical treatment for myself and/or my minor child and agree to be solely responsible for all medical expenses incurred.

I confirm my and/or my minor child medical fitness and authorization.

LIABILITY WAIVER, RELEASE & INDEMNIFICATION

To the fullest extent permitted by Illinois law, I, individually and on behalf of my minor child, understand, acknowledge, and agree that strict observation of all Gym rules and regulations, including those related to training and the use of protective equipment, is required.

I understand and acknowledge that my participation and/or my minor child’s participation in the Gym’s programs, classes, and activities carries a high risk of personal injury and may result in serious bodily injury, including but not limited to injuries to the knees, elbows, wrists, head, neck, joints, spine, paralysis, or death.

I, individually and on behalf of myself and/or my participating minor child, hereby voluntarily assume all risks of injury, loss, or damage that may be sustained as a result of participation in any program, class, or activity offered by the Gym.

I hereby release, waive, discharge, indemnify, and forever hold harmless Fit & Fight Gym Co. , its owners, officers, directors, employees, instructors, agents, authorized representatives, and other Gym Members from any and all liability, claims, demands, actions, or causes of action of any kind, including but not limited to claims arising from the negligence or gross negligence of the Gym or any of the foregoing parties.

This release includes, without limitation, any claims for personal injury, property damage, loss of life or limb, or expenses incurred by me and/or my participating minor child arising out of or related to my execution of this Agreement or participation in any Gym program, class, or activity.

I further agree to waive any and all rights to bring any civil action or legal claim under the law arising out of any injury, harm, or loss sustained by me and/or my participating minor child.

I agree to this Liability Waiver and Release.

PROGRAMS, SCHEDULING & TESTING

Scheduling, programming, instructors, and facilities are subject to change at the sole discretion of the Gym without notice. Members understand that instruction involves physical contact and hereby consent to such contact.

Upon recommendation by the Gym, Members may be required to participate in skills testing. Failure or refusal to test may result in suspension or termination at the Gym’s discretion, with all payment obligations remaining in effect.  

PARENTAL ACCESS POLICY

No Parental Access:
For the safety, focus, and privacy of all members, parents and guardians are not permitted inside training or workout areas during regular training sessions.

Drop-off and Pick-up:
Parents and guardians may drop off and pick up children only at the designated Gym entrance doors . Parents may not remain inside the Gym or training areas during sessions.

Communication:
All communication with Gym staff or instructors must occur at the front desk or via phone or email, outside of training areas.

Compliance:
Compliance with this policy is mandatory. Failure to follow this policy may result in restricted access or other actions deemed necessary by the Gym to maintain a safe and effective training environment.

GYM CLOSURES

The Gym is closed on major U.S. holidays, including:

• New Year’s Day

• Christmas Day
  

• Memorial Day
  

• Independence Day (4th of July)
  

• Labor Day
  

• Thanksgiving
  

• Eid al-Fitr (muslims holiday)
  

• Eid al-Adha (muslims holiday)
  
  

Classes may also be canceled due to weather or instructor unavailability. No makeups, refunds, or credits apply.

MEDIA RELEASE

A) I grant the Gym the irrevocable right to use photographs, video recordings, and/or audio recordings of me and/or my minor child for promotional, marketing, advertising, and other lawful purposes without compensation.

B) Unauthorized recording by Members , parents, guardians, or any visitors is strictly prohibited.

Members, parents, and guardians are not permitted to take photos, videos, or audio recordings of any kind during training sessions or at any time inside the Gym without express permission from Gym instructors or authorized Gym personnel.

C) The Gym does not provide or release any video recordings or footage from its cameras to parents, guardians, or any third parties. It is the Gym’s policy that surveillance and internal video recordings are for internal use only and will not be shared or distributed. Members and their families acknowledge that no individual requests for video access will be accommodated.

FORCE MAJEURE

The Gym is not responsible for closures due to events beyond its control, including pandemics or government orders. No refunds or credits apply.

OUTDOOR AREAS & EXTERNAL CONDITIONS

The Gym is not responsible for any injuries, slips, falls, or accidents that occur outside the Gym premises, including but not limited to parking lots, sidewalks, or any outdoor areas surrounding the Gym. Members and their guardians acknowledge that weather conditions such as ice, snow, or rain may create slippery surfaces, and it is their responsibility to exercise caution. The Gym’s liability is limited to incidents occurring inside the Gym facility.

PARKING LOTS & VEHICLE LIABILITY

The Gym is not responsible for any damage to vehicles, theft, or accidents involving Members’ or visitors’ cars in the parking lot or surrounding areas. Members acknowledge that the Gym does not provide security or monitoring of the parking facilities and is not liable for any collisions, damages, or incidents that occur in the parking area, including those involving other Members or third parties.

NON-TRANSFERABILITY

This Agreement is personal and non-transferable. Membership privileges may not be shared or assigned to another individual.

JOINT & SEVERAL LIABILITY

Any parent, legal guardian, or co-signer executing this Agreement agrees to be jointly, severally, and individually responsible for all obligations and payments under this Agreement.

JURISDICTION; SEVERABILITY; ENTIRE AGREEMENT

This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois. Venue for any action arising out of or relating to this Agreement shall be exclusively in Cook County, Illinois.

All rights and obligations of the Gym and the Member are subject to applicable federal, state, and local laws and regulations. If any provision of this Agreement is found to conflict with applicable law or to be invalid or unenforceable, such provision shall be deemed modified to the minimum extent necessary to conform to such law, and the remainder of the Agreement shall remain in full force and effect.

This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements, whether written or oral. No modification or amendment of this Agreement shall be valid unless made in writing and signed by both parties.

MINOR MEMBERS AND AGE VERIFICATION

Minor Members

If the Member is under the age of 18, this Agreement must be co-signed by a parent or legal guardian. The parent or guardian agrees to all terms and conditions on behalf of the minor and is fully responsible for ensuring compliance.

In the event that a minor under the age of 18 signs this Agreement without the required parental or guardian consent, the Agreement shall be considered null and void. The Gym reserves the right to immediately terminate the minor’s participation in any Gym activities until proper consent is obtained.

Age Verification

The Member (or the parent/guardian if the Member is a minor) is solely responsible for providing accurate and truthful information regarding the Member’s age. If it is discovered that the Member misrepresented their age and is under 18 without proper parental or guardian consent, the Gym may immediately void the Agreement and terminate the Member’s participation.

The Gym shall not be held liable for any misrepresentation of age by the Member. All terms of the Agreement remain applicable until such misrepresentation is discovered. Once discovered, the Gym will take appropriate action as outlined above.

I acknowledge and agree to all terms of this Membership Agreement & Liability Waiver, including assumption of risk, liability release, payment obligations, termination policies, and Gym rules. My electronic acceptance constitutes a legally binding signature.
