Installment Payment Method / Authorization for Payment
The Buyer hereby authorizes the company or its agents and/or assigns to electronically deduct/process on or after the due date for each consecutive billing cycle tuition payments directly from the following bank or credit/debit card accounts according to the terms of this agreement and to resubmit returned/declined items without prior notice. This payment information will be used to collect any balances past due according to the terms.
GYM SERVICES & MEMBER'S FITNESS
The Gym agrees to provide services to Member, such services being in the form of instruction and classes in the arts and sports of Wrestling, Muay Thai, Brazilian Jiu-Jitsu, and MMA (mixed martial arts). In order to receive Gym's services, an Individual is required to be a Member under the terms of this Agreement.
By executing this Agreement, Member represents, warrants and ensures that he/she has had an opportunity to observe the program selected prior to signing this Agreement and that Member and/or Member's minor child participating in the program, is physically and mentally able to participate in the program and classes offered by the Gym. Member acknowledges the Gym's recommendation to consult with a medical doctor and receive clearance prior to commencing participation in the program and member attests that he/she has either received such consultation and clearance or hereby waives the same.
NON-PAYMENT OF MEMBER DUES
Members are
strictly prohibited from participating
in any of the gym's programs, classes, events, or activities if their membership dues for the current month have not been paid in full. This includes, but is not limited to, access to workout facilities, group fitness classes, personal training sessions, and any special events or workshops hosted by the gym. Members must ensure that their payment is received and processed by the gym before they will be allowed to engage in any activities. No exceptions or partial allowances will be made under any circumstances. Failure to comply with this policy will result in immediate suspension of membership privileges until the outstanding dues are paid.
MEMBER'S RIGHT TO TERMINATE AGREEMENT.
Member shall be entitled to terminate his/her membership and this Agreement only on the following terms:

Month-to-Month Membership – no later than 5 (five) Gym business days before payment is due. In the event notice of termination is given later than 5 (five) Gym business days before payment is due, next month's membership dues will be charged to Member's account and shall be due and payable to Gym regardless of Member's lack of participation in Gym's program.

The termination notice must be delivered in person to the front desk by the member (or, if the member is a minor, by the member's parent and/or legal guardian) within the physical premises of the gym

Membership may be terminated by Member for any reason within 3 (three) Gym business days of the date of membership, with a refund of dues paid by Member, minus $25 for each class attended by Member after signing of the Agreement and before notice of termination of the Agreement.

Membership may be terminated by Member due to a serious injury received by Member during participation in the Gym's program, classes and/or during a martial arts and/or wrestling tournament sanctioned by the Gym, with a letter signed by a medical doctor describing the nature of the injury and prohibiting participation of Member in Gym's program. In such an event, the refund to Member shall be prorated for the number of prepaid days remaining in the membership.
DISCOUNT POLICY
If a Member who signed up for either a six-month or twelve-month program and received a discount on equipment or merchandise and subsequently terminated this Agreement for any reason, including injury, the Member shall be liable to the Gym for the difference in the discounted amount. The Member must pay the full price of any discounted equipment or merchandise purchased from the Gym.
PICK-UP OF MINOR MEMBER
Parent and/or legal guardian and/or other adult individual designated and authorized to pick up a minor child Member (with such signed written authorization for such non-parent adult to be on file with the Gym) shall be present inside the Gym by the main front entrance no later than 5 (five) minutes after the scheduled end of kids' class, activity, camp, seminar, and/or other program. The minor child Member shall be removed from the mat area and from the gym no later than 5 (five) minutes after scheduled conclusion of an activity involving minor child Member. The parent and/or legal guardian shall be liable to the Gym $1 (one dollar) for every minute after 5 (five) minutes expire after the scheduled conclusion of said child's class, program, and/or activity.
PARENTAL ACCESS POLICY

No Parental Access: For the safety, comfort, and privacy of all members, parents or guardians are not permitted to enter the gym facilities during regular training sessions. This policy is in place to create an optimal environment for all members to focus on their fitness goals without distractions.

Drop-off and Pick-up: Parents or guardians are welcome to drop off and pick up their children at the designated entrance areas of the gym. However, they must not enter the workout areas or remain inside the gym during the sessions.

Communication: If parents or guardians need to communicate with gym staff or trainers, they may do so at the front desk or via phone or email. We encourage open communication and are happy to address any concerns or questions outside of the training areas.

Compliance: Adherence to this policy is mandatory. Any violations may result in restricted access to the gym or other necessary actions to maintain the integrity of the training environment.
GYM FACILITY CLOSURES.
The Gym will be closed all day during the following holidays:

New Year's Day,

Memorial Day,

Independence Day,
-
Labor Day,
-
Thanksgiving,
-
Christmas Day,
-
Eid al-Fitr (uraza bayram)

Eid al-Adha (kurban bayram).
Moreover, a class will be canceled in the event that the instructor who teaches that particular class on a regular basis is unavailable due to illness or injury that prevents him from providing instruction, or due to that instructor's unavailability due to reasonable travel and/or participation in a tournament. The Gym will use its best efforts to find a substitute instructor for that particular class but shall not be obligated to do so. Moreover, the Gym will be closed during periods of inclement weather when in the sole discretion of the Gym personnel, commuting to and conducting Gym's program will be unsafe for Gym personnel and/or members. No make-up classes will be scheduled in lieu of Gym closures and/or class cancellations as aforementioned.
TOURNAMENTS, COMPETITIONS.
Although Gym instructors attempt their best to coach members at tournaments, competitions and similar events, which are not part of the Gym program, Member recognizes, understand and acknowledges that competing members greatly outnumber Gym instructors and that it is not possible for ever member to be coached at a competitive event by a Gym instructor, especially when several members compete at the same time. Gym instructors are under no obligation to attend tournaments, competitions and/or any events outside of the Gym's facility. Coaching of members is not a service included in this Agreement and such attendance and coaching are done on a voluntary basis without any compensation to the Gym.
DRESS CODE

BJJ-GI program. Member shall wear a GI (also known as a kimono) of any color and/or design of Member's choice. Such GI shall not display any other gym's or school's or affiliation's logo, patch or any such writing, except for the name of the GI brand. Member shall wear a short sleeve or long sleeve rash guard under the GI jacket.

BJJ NO-GI program. Member shall wear Grappling Shorts and Rash Guard with no display of other gym's, school's and/or affiliation's logo.

MUAY THAI program.
A) Member shall wear traditional Muay Thai shorts and a tank top, t-shirt, rash guard.
B) Minors MUST wear FIT & FIGHT Muay Thai shorts (otherwise they are not allowed to the classes and no exceptions.
C) Gym recommends that Member wear a tank top bearing Gym's Fit & Fight logo.

MMA (mixed martial arts) program. Member shall wear MMA or Muay Thai shorts and rash guard (strictly), neither of which display any other gym's, school's or affiliation's logo.

WRESTLING program. Member shall wear approved wrestling shoes, Grappling Shorts and must have a Fit & Fight Singlet of any colors.
MEMBER'S HYGIENE.
Member shall maintain clean hygiene of his/her body and clothes. Fingernails and toenails shall be trimmed short so as to avoid scratching another member and/or instructor. Long hair must be pulled back and secured. All jewelry, armbands, necklaces, etc., shall be removed prior to participation. Member shall not participate in Gym's program, classes and/or activities if Member has symptoms of the common cold, flu, Covid-19, measles, rash, infection or any other infectious and/or bacterial disease or condition.
MEMBER'S DUTIES:
1. Member agree to fully and completely comply with all the terms and conditions hereof and the Gym's rules and regulations. Except for as provided under the aforementioned terms of this Agreement, there shall be no refunds on any paid tuition or purchases.
2. Membership may not be put on hold and missed participation cannot be made up.
3. Member's failure to comply with the Gym's rules and regulations shall be grounds for immediate suspension or termination of the Member.
4.The suspension or termination of a Member shall not entitle the Member to a refund or credit for any tuition or test fees already paid, or shall act as a cancellation of any unpaid balance due.
5. Upon the suspension and/or termination of the Member, the entire remaining balance under this Agreement shall be immediately due and payable as liquidated damages and not as a penalty.
6. The failure or inability of Member to use the facilities, classes or services of the Gym for any reason, except as otherwise provided herein shall not relieve or suspend the Member's obligation to make all payments required under this Agreement.
7. If the Member no longer continues for any given reason and is granted, by the Gym, a cancellation, the Member (and/or Member's, if a minor) will be billed at a rate of $25.00 per class taken.
8. Gym reserves the right to use all photos, videos, and or audio taken of Member (including minor children) for promotional, marketing and any other purposes for the Gym's benefit.
9. Member acknowledge that there are additional charges for equipment, merchandise, special events, tournaments, change of uniforms and rank promotion examinations which are not included in the price of this Agreement.
10. Upon timely notice, the Gym may relocate within a 5 (five) - mile radius of its current location, and or to another affiliate location and same membership terms apply.
11. This Agreement is non-transferable and upon termination of this agreement by the Gym or cause, including Member's misconduct, no refund shall be due.
12. Co-signer, any person(s) signing this agreement as a co-signer or co-Member shall be jointly, severally and individually liable to the Gym and its billing company for the full amount due under this Agreement.
